Terms of Service

Effective Date: April 4, 2026

1. Acceptance of Terms

By accessing or using the website located at tridentbatco.com (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Site. These Terms constitute a legally binding agreement between you and Trident Sports Industries LLC, a Florida limited liability company doing business as Trident Bat Company (“Company,” “we,” “us,” or “our”).

2. Eligibility

You must be at least eighteen (18) years of age to use the Site or place an order. By using the Site, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Products and Orders

3.1 Product Descriptions

We make reasonable efforts to display product colors, dimensions, and specifications accurately. However, because wood is a natural material, actual products may vary slightly in grain pattern, color, and weight from images displayed on the Site.

3.2 Custom Orders

All custom bat orders are manufactured to your specifications. Custom orders are considered final sale and are non-returnable, non-refundable, and non-exchangeable except in the case of a wood defect as described in our Refund and Return Policy.

3.3 Order Acceptance

Your placement of an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including errors in pricing or product information. If we cancel an order after payment has been processed, we will issue a full refund.

4. Pricing and Payment

All prices are listed in United States Dollars (USD) and are subject to change without notice. Payment is processed at the time of order through our e-commerce platform, Shopify. We accept major credit cards, debit cards, and other payment methods made available through Shopify.

5. Shipping and Fulfillment

We target a fulfillment window of seven (7) to ten (10) business days from the date of order confirmation. This timeframe is a best-efforts estimate and is not a guaranteed delivery date. Shipping times vary by destination. Risk of loss and title to products pass to you upon delivery to the carrier.

6. Intellectual Property

All content on the Site, including but not limited to the Trident Bat Company name, logos, trident mark, product designs, images, text, and graphics, are the exclusive property of Trident Sports Industries LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

7. User Conduct

You agree not to use the Site for any unlawful purpose or in any manner that could damage, disable, or impair the Site. You may not attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site.

8. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TRIDENT SPORTS INDUSTRIES LLC DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRIDENT SPORTS INDUSTRIES LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Trident Sports Industries LLC, its members, managers, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

12. Dispute Resolution

Prior to initiating any formal legal proceeding, the parties agree to attempt in good faith to resolve any dispute through informal negotiation for a period of thirty (30) days. If the dispute cannot be resolved informally, either party may pursue legal remedies as provided herein.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated effective date. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, Refund and Return Policy, and Product Liability Disclaimer, constitute the entire agreement between you and the Company regarding your use of the Site.
